Terms of Service

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Builder360 ("we," "us" or "our"), concerning your access to and use of the Builder360 website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

2. Products and Pricing

All products are subject to availability. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change without notice. We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site.

3. Delivery & Service Area

Currently, Builder360 operates and provides delivery services exclusively within the districts of Karnal and Panipat. Any orders placed for delivery outside these designated service areas may be subject to cancellation.

Delivery timelines provided are estimates. Due to the nature of construction materials and logistics, delays may occasionally occur.

Site Approach Road Responsibility: It is the customer's strict responsibility to ensure that the approach road to the delivery site is wide enough, solid, and clear of obstructions for heavy commercial vehicles (like tractor-trolleys or dump trucks). Failure to provide adequate site access that results in the vehicle being turned away will result in additional delivery charges and/or cancellation fees at our discretion.

4. Breakage Tolerance & Returns

Due to the heavy and fragile nature of certain construction materials during loading, transit, and unloading, standard industry breakage tolerances apply:

Standard Breakage Tolerance

  • Bricks & Blocks: A breakage or wastage tolerance of up to 5% is standard in the industry and is entirely non-refundable. Claims for breakages will only be entertained if the total broken quantity significantly exceeds this 5% threshold upon immediate inspection at the time of delivery.
  • Other Materials: For materials like cement, returns are generally not accepted once the seal is broken or if stored improperly by the buyer.

Where applicable and approved, we offer replacements for damaged goods exceeding the tolerance limit rather than direct monetary refunds.

5. Payments

We accept payments via our secure third-party payment gateway, Razorpay. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, or delays in construction schedules arising from your use of the Site or our services.

7. Governing Law

These Terms shall be governed by and defined following the laws of India. Builder360 and yourself irrevocably consent that the courts of Haryana shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
